Terms & Conditions of Use including Website Security

1. This website (Site) is operated by Gurrumul Yunupingu Foundation –

ABN 25163166283 (we, our or us). It is available at: https://gurrumulfoundation.org.au/ and may be available through other addresses or channels. If you continue to browse and use this website, you are agreeing to comply with and be bound by the following Terms & Conditions of use, which together with our privacy policy govern Gurrumul Yunupingu Foundation’s relationship with you in relation to this website. If you disagree with any part of these Terms & Conditions, please do not use our website.

2. Unless otherwise indicated, we own or licence all rights, title, and interest (including intellectual property rights) in our Site and all the Content. Your use of our Site and your use of and access to any Content does not grant or transfer to you any rights, title, or interest in relation to our Site or the Content.

You cannot:

  • copy or use, in whole or in part, any Content

  • reproduce, retransmit, distribute, disseminate, sell, publish, broadcast, or circulate any Content to any third party; or

  • breach any intellectual property rights connected with our Site or the Content, including (without limitation) altering or modifying any of the Content, causing any of the Content to be framed or embedded in another website or platform, or creating derivative works from the Content.

3. You cannot do or attempt to do anything: that is unlawful; prohibited by any laws applicable to our Site; which we would consider inappropriate; or which might bring us or our Site into disrepute, including (without limitation):

  • anything that would constitute a breach of an individual’s privacy (including uploading private or personal information without an individual’s consent) or any other legal rights;

  • using our Site to defame, harass, threaten, menace, or offend any person;

4. By using our Site, you acknowledge and agree that the internet is fundamentally insecure and that you use the internet at your own risk. When browsing online, it is important to take steps to protect yourself from cyber threats. You should also be careful about what information you share when using a public network. We recommend that virus checks are undertaken on any downloaded content from our website or links.

Gurrumul Yunupingu Foundation is not responsible for any loss or damage suffered in connection with the use of this Site or its content, or in connection with any materials contained on any other website, online service, or other materials to which we provide a link. The links to other websites are provided for general information only and Gurrumul Yunupingu Foundation does not claim to approve or endorse any of the links. We make no warranties or representations in relation to the accuracy, reliability, timeliness or otherwise of our Website’s content or links. We also do not represent or guarantee that our content or links are free of computer viruses or other defects. You acknowledge that you do not hold Gurrumul Yunupingu Foundation liable for any security breaches, viruses, Trojans, or other malicious software that may infect your computer or any loss of data, revenue or otherwise that may occur because of using our website.

6. Specific sections of our Site are secured using industry-standard SSL/TLS technology to encrypt data between your browser and our Site. If you are entering any payment or credit card information on the internet, you should confirm that the page is secured (padlock symbol is displayed in your browser) before entering any information. The payment processing is managed on an encrypted implementation of Stripe, so our Site never sees or holds any credit card information which could be compromised.

7. Please do not forward credit card numbers or other sensitive information via email or facsimile as it is not safe.

8. The Gurrumul Yunupingu Foundation will never contact you requesting your credit card number and CVV number. This type of phone call should be considered a hoax, you should disregard it and immediately report the contact to scamwatch.gov.au.

9. If you are considering sending us any personal information through our Site or other electronic means, please be aware that the information may be insecure in transit, particularly where no encryption is used (e.g. email, standard HTTP).

10. The Site may contain links to other sites including social media sites. We do not have any control over those websites, and we are not responsible for the protection and privacy of any personal information which you provide when visiting those websites. Those websites are not governed by our Privacy Notice.

11. Our Site may be accessed throughout Australia and overseas. We make no representation that our Site complies with the laws (including intellectual property laws) of any country outside Australia. If you access our Site from outside Australia, you do so at your own risk and are responsible for complying with the laws of the jurisdiction where you access our Site.

12. To the maximum extent permitted by law, you must indemnify us, and hold us harmless, against any Liability suffered or incurred by us arising from or in connection with your use of our Site or any breach of these Terms & Conditions or any applicable laws by you. This indemnity is a continuing obligation, independent from the other obligations under these Terms & Conditions, and continues after these Terms & Conditions end. It is not necessary for us to suffer or incur any Liability before enforcing a right of indemnity under these Terms & Conditions. 

13. Changes may be made to this Site from time to time. However, the Gurrumul Yunupingu Foundation makes no representation that the content will be updated, and we are not liable for any losses suffered in relation to our content or links when they are out of date.

14. We may, at any time and without notice to you, discontinue our Site, in whole or in part. We may also exclude any person from using our Site, at any time and at our sole discretion. We are not responsible for any Liability you may suffer arising from or in connection with any such discontinuance or exclusion.

15. Your use of our Site and these Terms & Conditions are governed by the laws of the Northern Territory. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts operating in the Northern Territory any courts entitled to hear appeals from those courts and waive any right to object to proceedings being brought in those courts.

16. In respect of the Gurrumul Yunupingu Foundation logos you cannot reproduce or use the logos unless we provide our prior approval in writing. Permission to use Gurrumul Yunupingu Foundation logos must be sought in writing by contacting: admin@gurrumulfoundation.org.au
